Hi, I have posted a topic about underground oil tank issue. Thank everyone who replied. Now we realize how important to get the bottom of this issue. I am so unsatisfied with our agent and lawyer. We have not signed the contract yet. our lawyer received the contract from the seller lawyer, and did not do a good job to review. I am wondering if we can still change our lawyer at this point if we want to buy this house, we do not have any verbal or written contract with this lawyer, he is supposed to be paid when the house is closed. We know we cannot change the agent for buying house, but can we change the lawyer at this point? Do we owe him any money? Thank you very much for any input.

I'd find another attorney you feel more comfortable with and get his/her opinion. I don't know NY law well enough, but it would seem that if you have nothing either verbal or written, you should be able to get out of your engagement with him.

One question for you: if you have no verbal contract, why are you saying 'he is supposed to be paid?' I'm no lawyer, but it would seem to me that could be construed as a contract of some form.

At least from what I've seen of attorney contracts in other states, you can fire your lawyer any time you want. You may have to pay them some money, but you won't have to continue working with them. Maybe you could work something out between the old/new lawyer, say the old one gets a bit of $ for the time/trouble he's spent so far. But if he's been incompetent (and many of them are), I'd push to not give him anything.

Good luck and consult a professional to get the best answer.

Not a lawyer but a real estate investor if i can help u let me know...if you have any other specific ? Regarding your sale.... This isyour biggest decision of your life...if your not happy run away and deal w bad lawyer later..

Fire the lawyer if you don't like him. However, if he was named as you lawyer (he did receive the documentation) you will probably have to negotiate some fee with him for work performed.
