I recently returned to my position after 11 weeks out on FMLA due to illness. Five weeks into my leave, I found out that my employer put someone else in my position. I have worked for my company for 2 years and was complemented and praised prior to my leave. I later found out that my employer wanted me to return but they wanted me to return with a demotion reporting to this person that replaced me with a $20,000 cut in pay. I consulted with attorney's and FMLA and found out my rights. Bottom line is I returned to my job with my title, same salary, commissions, and employment terms and conditions. My responsibilities have changed somewhat. When they informed me I would be returning with everything that I requested under FMLA rules and regulations, they sent me a letter with several false allegations about my job performance. Prior to this experience, I had a clean employment file. I returned a letter correcting their false allegations. I used to have an excellent working relationship with my boss prior to my leave and since my return, she is micro-managing me and keeping me on a very short line. It is total retaliation for the letter I wrote the owner about her and because I fought for my rights and won. I was wondering if anyone has ever experienced retaliation from an employer and what could be done about it.
