Would a person working part-time as a tutor in-home, in libraries, in after-school programs, etc for a tutoring company or part-time as an in-home therapist for a company be an independent contractor or an employee? Assuming they could accept/reject assignments given to them and that they are in a 'pool' of tutors/therapists that each of the respective companies uses. The tutors and therapists are paid hourly.

Sorry about the awkward wording. Ask for clarification, if needed.

Sounds very much like a contractor position.

You have the general contractor or agency advertising the jobs, and subbing those out to a pool of subcontractors.

most employment is employee employer relationship. the indepedent contractor argument is a dodge to get out of employer obligations. this movement would never have occurred but for the american hatred of unions.
which they will live to regret. the current assumption, that if you work hard and honestly the government and employers will treat you fairly, is a giant bubble, about to be popped.

Have you ever worked as an independent contractor?

My husband is an independent contractor (oil and gas consultant). I was one for many years (realtor). This choice had NOTHING to do with any employer trying to get out of employer "obligations" and EVERYTHING to do with personal freedom and owning our own businesses - with all the risks and all the rewards of that ownership. As independent contractors, we can choose when we work, who our clients are, what assignments we want to take and don't want to take, etc. Generally the pay is quite a bit higher as well. Yes, we have to buy our own insurance and no one pays our holiday or vacation pay (except us!) but believe me, the pay is worth it. Basically, as an independent contractor, you own and run your own business.

My husband went from employee to independent contractor and tripled his pay within one year. I doubled my pay in real estate as an independent contractor. Good times!
