I am in the process of drafting a complaint against my former employer for disability discrimination as well as retaliation.

Basically I provided the necessary medical documentation from my physician that the employer required to get the process started. After that everything still went down hill. I was still being instructed by one of the team leaders to do things that was against the reasonable accommodation that they approved.

The strange thing about it the jobs that they were forcing me to do wasn't done by all the employees so that can't claim that it was undue hardship to accommodate me.

As far as retaliation goes: I got the same team leader tell me " you don't need that kind of assistance other workers do".

During the final step of very project they will provide assistance. Everyone else would be provided assistance but me. Also everyone (employees) had a relief within their department but I was given a relief outside of my department so I would have to hunt and track down the person.

I have all of this one record.

I am hoping for mediation and hoping to get the matter resolved. I'm not unsure of which agency to go with.

Does anyone have any experience with filing me one of these agencies? I've read on some of the threads on here that EEOC mediation is a joke. I haven't seen much information on the NYSDHR.

I am hoping it won't due to the fact I have proof of the employer--through the team leader of failing to accommodate, retaliation -- based on denying assistance which is provided to other workers and providing me with a relief outside my department and giving all the other workers a relief within their own department.

In New York, employees have the benefit of a terrific bar association comprised of employment lawyers who represent primarily employees. The bar association has a lawyer referral service, and as part of that service, the lawyers agree to provide the first half hour of consultation for $25. After that, consultation continues at whatever rate the client and attorney agree upon.

The choice of agency to file with may be an important strategic choice. (I am not a NY licensed attorney; so I don't know for certain what strategies if any need to be considered, but in other states, the choice is an important and strategic one). So, spend the $25 and talk with an experienced employment lawyer. Here is a link that will lead you to a roster of available lawyers: NELANY.
