I have a 2012 automatic base mustang gt which has been through step 2 of the lemon law process where the car was out of service more than 30 days and repairs were still not done correctly, and thus i have gone to step 3 asking Ford to give me a new car (and certified mailed the request). If i understand the law correctly Ford now has 20 days from receipt of my written request to replace the car.

Anyone been through this? Would they just give me a new 2013 base mustang gt with automatic transmission, same color and upgrades i had before (since the same features are still available)? I deed 2012 car to them and loan transfers to 2013? Will they try to negotiate to get me to keep the 2012 and offer cash + extended warranty or any other tactics i should be leary of?

I have no clue how this works. You seem to know your rights based on the steps you've already taken. I'd hate to think you need a lawyer to deal with a situation like this, but that might be where you're headed.

Here's the full law - You definitely won't be getting a 2013 model.

(1) If the manufacturer, its agent, or the new motor vehicle dealer is unable to repair or correct any nonconformity in a new motor vehicle after a reasonable number of attempts.

Where are you getting your "steps" information from - a car dealer is a huge corporation and I'm sure will fight the "reasonable number of attempts" and the far that they did repair it?

Bell,

You posted the OLD lemon law.

Apparently Ford has 20 days to get me a replacement new car which would most likely be a 2013 since the 2012 models are probably all sold or they can refuse and try to negotiate something else. If they refuse and we don't reach some type of agreement, then off to arbitration and if i win in arbitration i will get the replacement car.

The Lemon Law doesn't apply to used cars at all? Even if you have documentation of lies?

I used to work for the Governor's Office of Consumer Protection--the state agency that regulates the Lemon Law. Yes it is true that the law only applies to new vehicles. Contact them if you have any other questions during business hours at 404-651-8600 or 1-800-869-1123.

The first post in this thread is a year old. I am guessing that he bought a bend new 2012 Mustang at that time. There were a lot of new 2012 models on dealer lots at that time.

Yes, purchased the 2012 as a new car. Long story short, Ford replaced it with an identical 2014 a few months ago.

Gratz!! I guess that settles the question as to whether or not you can get a later model car out of the deal. I am sorry it took them so long to get you a new car, though.
