Question about home/builder warranty when you purchase used (foreclosure, new home)

I have never bought a new construction home, but I know they usually come with some sort of warranty. For most things, I know it's a year.

Our current home is 7-8 years old and I am wondering if we may have any structural warranty? I hear they are sometimes for 10 years or so? This home was purchased as a foreclosure, so I do not have any original paperwork. The builder is Legacy and we bought it slightly over a year ago.

I wanted the builder to come out and check out some cracks in the foundation. They were pointed out during our inspection, but I was told they were cosmetic. I just want to be sure.... and if they are a problem, and we have a warranty, I would want to address it before it runs out.

Anyone familiar with Legacy warranties?

I do not know anything about Legacy warranties, but, I can tell you about our Newmark (10-year) warranty we got when we bought our used house (it was used, also - 1 yr old).

We had one incident covered under warrant...a toilet was leaking (very slowly) around the base and had eventually damaged the floor (otherwise, we never would have known). We called Newmark, who gave us the name of several plumbers to call. They informed us up-front that if the problem was not related to the installation/construction of the toilet/bathroom, we would be reponsible for the cost of the inspection. If it turned out there was an installation problem, they would cover the inspection and all repairs.

In our case, the toilet flange had been damaged, and the plumber said that could only happen prior to the seating of the toilet, so Newmark paid to have the flange fixed and the floor entirely replaced (it was a 'powder room' bathroom, very small).

Flash forward many years (4 or 5?) and there is damage around the toilet again. Same deal - call Newmark, get disclaimer, have plumber come out. He does not pull the toilet, but explains what the problem probably is (very slow trickle leak through the tank to the bowl, probably damage to the wax ring from 'erosion', and probably NOT an installation or reinstallation issue). He says he can pull the toilet to confirm, but then will have to charge for the visit and we would probably be liable for that cost (he opted not to charge for the visit since he did not pull the toilet). We opt to agree with him and pulled the toilet last week. As far as we can tell, he was correct - flange looked great, and ring APPEARED (hard to tell) to have been placed correctly. Again, if there hadn't been a wood floor (doh!) then we never would have known there was any issues.

Long story, but the idea is the same - you probably have a warranty, but you are responsible for the inspection cost. If it is a warranty issue, they will reimburse you, if not, you are stuck with the inspection cost.
