A federal judge has struck down Nebraska's ban on same-sex marriage.
According to an injunction filed in federal court Monday, Senior U.S. District Judge Joseph Bataillon said "all relevant state officials are ordered to treat same-sex couples the same as different sex couples in the context of processing a marriage license or determining the rights, protections, obligations or benefits of marriage."
The state of Nebraska now has seven days to beg the Eighth Circuit Court of Appeals for a stay of the decision pending appeal - of course, it will never get as far as a ruling by the 8th since the United States Supreme Court will settle the matter once and for all before the circuit court could schedule briefs and oral arguments and issue a decision.
Judge Bataillon was nominated to the federal bench by President Clinton and his nomination was confirmed by unanimous consent of the United States Senate in 1997.

Actually, the group of judges who have overturned unconstitutional same-sex marriage bans are a pretty bipartisan bunch.

Normally I support states rights but I am a social libertarian by nature. I see no reason in 2015 to ban gay marriage. People who cannot let other people live the way they want to live if it's not hurting anyone else do not deserve to be called 'freedom loving' and that includes supporting the war on drugs/marijuana.
