So the DOJ is charging the agent with murder. He claims they were throwing rocks at them from the mexican side, but the mother is claiming that her son was walking home from a basketball game.

According to the Department of Homeland Security agency, rock throwers have attacked agents more than 1,700 times since 2010. The Monitor reported that US border patrol agents have fired across the border at least 12 times in the past five years, killing six Mexicans standing on Mexican soil, according to a 2013 joint investigation by Washington Monthly and The Investigative Fund at The Nation Institute, a nonprofit media center.

Was the mom walking with him? Does not matter if he was walking from basketball game AND throwing rocks.

What business do they have throwing rocks at agents anyways . The mexicans have no respect for america or its laws or anything. I guarantee you that obama also pushed for this agent to be charged with murder. To me this is not murder it was totally warranted . I hope this agent is found not guilty. Any other country in the world all the rock throwers would have been shot and that would be the end of it.

Why is the DOJ charging him? Surely if the shots were fired into Mexico and a Mexican national was killed then it would be up to the Mexican authorities to charge him and to request his extradition.

He is apparently being charged under federal rather than state law because he was on federal property (the border fence zone) where the U. S. government has exclusive criminal jurisdiction when he fired the shots. As for granting extradition to Mexico, it would be the same as delivering him to a lynch mob.

DOJ is charging him probably because obama is forcing them to.Same went for when george zimmerman was acquitted, obama tried digging up federal crimes on him also , which led to a dead end..

This has happened several times in the past. It's always the Border Patrol deemed guilty. Rocks can be a lethal weapon if they are large enough. Oh of course, the kids are going to tell their mothers that they are innocent. These border agents should have the right to protect themselves from these assaults.
