The 'hot coffee' thing gets brought up quite a bit.. Which.. Honestly, there's more to it than most people realize.. But this..

Perhaps the women should get sued for illegal trespass causing injury and the courts could order them to pay the exact amount of the cost of their injuries back to the property owner.

Yes, anyone who wants to ridicule the McDonald's hot coffee lawsuit should just Google "Stella Liebeck's burns" to see what actually happened to the woman.

As for the two women in this thread, I can't believe there were no employees present to assist them in the closed waterpark in the "early hours of the morning."

Injured while trespassing ...

Yeah, Stella was always pouring coffee on herself just to stay warm. This cup just happened to be more than very hot and wet, it was very, very, very, hot and wet. Duh!
Accidents happen, regardless of how hot the coffee was it, was Stella's (not McDonald's) fault it spilled. If it hadn't spilled it would be a non-event, she would have gone merrily on her way happy and bragging about her piping hot coffee, instead of the luke warm stuff from Bojangles.

The two women in the above link prove you can legislate all you want, but you can't make laws that save people from doing stupid stuff. These are the kinds of lawsuits that should penalize the idiot to discourage others from seeking monetary offers that would save the insurance company less than the cost of litigation.

Had that McDonald's coffee not been meant as a product to bring into and consumed in a moving vehicle I might agree with you. It was take-out coffee and it was scalding beyond reason.

As for the facts of Stella's case, you are obviously ignorant to them, just as most people are. The sad fact is that most people don't care that they are ignorant to the facts. They know what they know and that's all that they care to know.

As for the women on the slides.... Arrest them for trespassing.

Perhaps the women should get arrested for illegal trespass, since they have admitted to such in a court document.

It’s sorta like the people who defended Adrian Peterson (football player) disciplining his young child with a switch. That is until you google the story and see pictures of his boy; then you lose support real quick.

The law in most states divides those who use property into three categories: Business invitees; licensees; and trespassers.

No duty of care is owed to trespassers, the exception being a child trespasser who can make an argument that the reason they were on the property is because the land owner created an "attractive nuisance" (perhaps a swimming pool).

A limited duty care is owed to licensees. Licensees are people who have permission to be on your property, but are not there for your economic or other benefit. Generally, the law says that a warning that dangerous conditions exist on the property is sufficient to satisfy any duty of care.

The greatest duty is owed to invitees who are on the property for your benefit. Examples would be customers of a business or repairmen fixing things on your property.

I suspect that South Carolina follows a similar scheme. This, of course, means this lawsuit is unlikely to go anywhere and is subject to dismissal.

I think it's ridiculous that she sued for an injury she incurred while trespassing. She should be arrested. When I broke my wrist and arm ice skating the insurance company wanted to know if there was anyone I was suing. Well no. I did it to myself. Case closed. Honesty seems to be an option these days.

No, what it proves are that there are dumb people in this world. The system will make short work of this lawsuit. The problem with imposing penalties on those who bring these lawsuits is that you may--in the process--stop ten other people from bringing a totally legitimate lawsuit.
