"Dogs are chairs; they're furniture; they're automobiles, they're pensions. They're not kids," Tomasello said.
ugh, that judge is a jerk to have said that!
I don't see why they can't both agree to share custody of the dog. it sounds like the guy got jealous or something once his former fiancee started dating again. this is going to end like like that Biblical story w/ the two women fighting over a baby. it may be that someone will need to consider which home is best for the dog and voluntarily give him up (hopefully the juge doesn't volunteer to cut him in half, though he's already made one callous remark in regards to this matter)

It's upsetting to read a quote like that. The thing is, according to the law as I understand it, he's right. I think it's been changed in a few places but mostly the law regards an animal as property.
I had a neighbor in California, "Fireman Dave". He had an ex girlfriend, and after they broke up she went through the courts to get visitation/partial custody to their American Bulldog. Once Fireman Dave got a new gf, the ex stopped her visits and taking the dog.
The articles says once she started dating again, he stopped letting her see the pug. I think it's false hope of getting back together, he kept the dog so he could see her, the dog still connects them.
You know, I love my dog dearly and probably would fight an alligator for him if the need ever arose but at some point before I found myself $20,000 in the hole I think I would just let my hypothetical ex-wife have the dang dog. I think the wife would get awfully tired of dealing with my dog on her own and hand him over after a few weeks anyway.
