The typical liberal narrative is that the Court decision was a rebuke to Bush. Actually it was a rebuke to both Congress and the Executive branch. It invalidated two laws passed by Congress dealing with the subject of the detention of unlawful enemy combatants. In effect this was a pure power grab by the Court. The conduct of war is a power primarily vested in the Executive branch and secondarily in the Congress through its power of appropriation and oversight. The Constitution vests no war-making powers in the courts.
In WWII there were over 400,000 German POW's on American soil. Not one was ever given the right to challenge his detention in American courts. So this move by the liberal wing of the Court is absolutely unprecedented and will inevitably end up killing Americans. Of course there is a way around the ruling: take no prisoners.
