Oh, that just sucks and sounds like my HOA. She's got alot of headaches ahead of her.
You know when the HOA budgets during their annual meeting the cost of repaving was anticipated. So was and estimated date. Those things should have been posted well in advance of the work.
That being said, common sense tells me if I go away, I make sure someone local has a contact # for me - especially this time of year (hurricane season), in case of emergency.
And I wonder if the tow truck company even tried contacting her and to what degree.

Why not tow the car to already paved spot and charge her for towing????? HOA use your Common sense

I originally thought the car owner was wrong because they didn't leave a contact #. After reading B4U's post I see now they should have given notice ahead of time, way in advance. They should have sent notice in the mail and posted it. Maybe they did and it's not mentioned in the article and the car owner forgot due to being sick which delayed returning home in time to move the car. If they didn't post and mail notice of the paving then I would hold them responsible. That car was worth a lot of money and considering the small fee for towing compared to the value of that car they could have paid the bill and passed it to the car owner or made arrangements with the towing Co. to bill the car owner for moving/relocating the car until the paving was completed.

I don't think the car owner didn't have a cell phone. I wonder why they didn't have emergency numbers on file for all owners. This could have all been avoided had the Association handled it properly, which IMO they didn't. I hope the car owner wins.
