I know it has been posted on this thread somewhere but after extensive googling I can't find it, has anyone had any luck or can anyone give me advice as to how to obtain a parent's birth certificate from NYC if they do not consent to giving it to you?

That link is for NYS, I have tried the NYC link as well. The NYC states it only releases to the person or the parents. Both parents are deceased.

The NYC site at Ordering A Birth Certificate says:
"You can get a birth certificate for yourself if you are at least 18 years old, or for your child, or for a deceased relative with current identification."
And:
"If you're ordering a birth certificate for a deceased relative, you must do so by mail or in person."

I would agree that the instructions on the mail-in form itself do not quite agree with the above statements. I would try calling the NYC people at "For more information, please call 311 or 212 NEWYORK (212-639-9675)" and see if they will clarify how you can get your deceased parent's B/C.

I've successfully ordered birth certificates using the form - by mail, for deceased relatives.

You need to prove the person is dead for a certain amount of time in most locations, including NYC. If you can don't have a death certificate, get the funeral director/funeral home or cemetery to come up with the death certificate or its NUMBER, you can prove this. A court can give you permission. Also, if it is for something like a medical reason, there are exceptions

I have gotten birth and death certificates for deceased in-laws from NYC. All I did was request them in my married name. They never asked for proof if I was a blood relative.
