I work for a company in Orlando FL, but the parent company is in NYC and they manage our benefits. I signed up for this year's flex spending account, and have had funds taken out of every paycheck. However, I cannot file claims against it, because our parent company has never filed my enrollment with the company that manages the flex spending account. They have tried many times to contact the person at our parent company who is responsible for this account, but get no responses. I have had our office manager and our VP contact this person. One time he responded "I'll get around to it in a few days". Another time he responded "I'm really busy right now" (it takes five minutes to sign and fax my enrollment sheet to the company). It has been over two months and I have hundreds of dollars of claims for which I am unable to get reimbursed, and the company has taken hundreds out of my paycheck supposedly to fund my account. Does anyone know if they are legally even entitled to take funds out of my check without enrolling me? Any suggestions? Its become quite a hardship for me (my son had some major dental work done recently and I really need to be reimbursed for it).
With my FSA, they take money from my pay each pay check and they issued me a 'credit card'. For example...my FSA account had $500.00 in it. So at the 1st of the year they issued me a credit card with that amount limit on it. Did you not get a credit card?
I would be really upset if they were deducting money for an account I could not use...I would be demanding a full refund of the money you earned or an immediate reimbursment...tell them you are going to get your attorney involved because they are stealing your pay from you...

I just found out that they're dropping the Flex Spending Acct (due to lack of enrollment) and refunding my contributions in my next paycheck. I also heard that they're dropping the 401K plan (along with the matching contributions). Sheesh...two benefits gone. Not a good sign. Thanks for the replies.

Make sure that you watch how they reflect these transactions in your
W-2 for 2009. In fact, you should already now check with your tax accountant what to watch out for. You may also want to contact the benefits department of your company and inquire about the tax treatment. FSA pre-tax deductions appear in a particular box of the W2. Make sure that the right amounts are in the right boxes come next year and keep all your documentation. The larger the company, the bigger the black hole things like these fall into and it takes time to correct their errors.
