(Washington, DC) – Judicial Watch, the organization that investigates and fights government corruption, announced today that it filed an amicus curiae brief with the U.S. Supreme Court on behalf of the State of Louisiana challenging a current federal policy in which “unlawfully present aliens” were counted in the 2010 Census (Louisiana v. Bryson).

The government used these census numbers to reapportion seats in the House of Representatives and, as a result, the State of Louisiana lost a House seat to which it was entitled. Louisiana is asking that the Supreme Court order the federal government to recalculate the 2010 apportionment of House seats based upon legal residents as the U.S. Constitution requires.

Amici respectfully submit that neither Article I Section 2 of the U.S. Constitution, the Fourteenth Amendment, or any other provision of the Constitution authorize or permit the inclusion of unlawfully present aliens in the apportionment process. As a result, this case raises issues critical not just to Louisiana, but to every State, every American citizen, and our federal system of government.

This should be interesting. The inclusion of illegal aliens gives them the false impression that they have representation in Congress. This is why Dreamies frequently tell each other to email, call, and/or visit "your" representatives.

I think it totally unfair that illegals get counted in the census. The results of that affect representation in congress on both the state and federal levels. It gives illegals a voice in our politics and that is ridiculous.

It's a census count, not a citizen count.

ILLEGAL aliens DON'T need to be counted by the census. They DO need to be shunned.

We know that. But, the census count impacts our Congressional seats, which is precisely why illegal aliens should NOT be included. If they want to count everyone residing in this country, they should exclude "non-citizens" from that apportionment process. After all, non-citizens do not have Congressional representation. Not to mention, illegal aliens have no legal right to even be here.

The Census has one constitutionally mandated purpose: to count the number of people who live in the United States. If you want to shun people, that's your business, not the Census Bureau's.

Your notion that non-citizens do not have Congressional representation is belied by the plain language of the Constitution which makes no distinction between citizens and non-citizens for purposes of apportionment. You might want to petition for an amendment.

Written in 1787, ratified in 1788, and in operation since 1789, the United States Constitution is the world’s longest surviving written charter of government. Its first three words – “We The People” – affirm that the government of the United States exists to serve its citizens.
U.S. Senate: Reference Home > Constitution of the United States

The last time I checked, illegal aliens are NOT citizens.
