Voidable RE contract for non-performance? (brokers, home, legally)

When we were in the process of selling our home up north, our realtor included a clause in the contract that basically said we were entitled to cancel the contract if we were unhappy with her performance. A number of companies were competing for the listing but this was the enticement to go with that particular realtor, which we did. At the time we thought that "voidable contract" was an oxymoron but sure enough it was written right there in the contract that we could cancel before the 6 months were up.

That realtor worked her tail off to do the sale. I am putting this out there for any realtors who might know whether or not such a clause could be legally written into RE contracts and if so why wont sellers in this market take advantage of it.

I also always put that clause in my contracts. There may be some brokers that do not allow their realtors to put that in their contracts. I think that is up to the broker.

I see it as a benefit to both parties.

As Cricket pointed out, it can highlight the realtor's confidence and make that realtor stand out when a seller is choosing a realtor.

For the seller, choosing a realtor is a great unknown unless you've worked with that particular one before. So having that option to end the contract is reassuring.
