What about crossing the border from the USA into Canada with a pending felony charge? Will it show up though not convicted yet. I want to attend a friends wedding.
I would go with your lawyer and see the court orderly/department that is dealing with your case. They can issue a document verifying that you have the court date pending sentence and indicate when the hearing is due. All you have to prove is that you will be returning to the place of residence/your job and have consistency in your life. The court orderly can also state that this doc is issued for you to be able to attend a relatives wedding in the USA. It seems pretty understandable that if you do come up on records at an Immigration post and have this doc in your possession, the authorities would be more understanding of your situation.

I was charged with assault (fight) in 1999 but not convicted of anything, community service only, no records. I got a pardon in 2005. I think since then I've had one speeding ticket, and even it got thrown out.
Unfortunately since I crossed into US between those times that arrest is in the INS database and sometimes I get hassled and it is embarassing when I have family in the car.
Is there any way to contact the INS and tell them about the pardon. This is a problem. I'm not going to get involved in anything criminal.
The US does not recognize pardons from Canada. Specifically was it a Section 266 assault? If yes, you will be allowed into the US. As to removing the lookout, that can be problematic.
I am wondering if anyone knows about crossing the border from Canada to the USA with a pending charge.He has no criminal record at all but my boyfriend was charged with possesion of a weapon. He doesnt go to court for 12 months. Will he still be allowed in before hes found innocent or guilty on the charges? Is he innocent until proven guilty? He has been to the USA dozens of times before this. Will it not show until hes actually convicted? I appreciate your responses. Thanks
Depends. At some crossings, the officers may want to see disposition records. Specifically, was he indicted or was it a summary conviction? Until that is decided, he may have a problem. He might have to wait until the case is decided.
If a case is pending so the usa border see the actual charge that it was.i know they see that you have a pending charge but do they see why the charge is about
