Hi Everyone, we are to trying to evict our tenant in Suffolk County, NY. Lease ended March of this year, but the tenant doesn't want to move out. We hired a lawyer and took these folks to court and we agreed to a settlement before trial. We have a Stipulation of Settlement via our lawyer; however found out that the tenants are not going to move out by the agreed date. I have 2 questions:
1) Is it possible for the tenant to extend or delay the sheriff eviction after agreeing to Stipulation of Settlement? I was researching online and read something about Order of Cause for relief. I can't believe this is possible after agreeing to a settlement. On the Stipulation of Settlement form, it says that "tenant consents to immediate entry of a judgement of possession and the issuance of a warrant of eviction." Also, my lawyer has written on the form that we have the right to accelerate execution of the warrant in the event the respondent fails to comply with terms of this agreement.
2) I called the Sheriff in Suffolk County and they said that it takes 4-6 weeks from the time they get the papers to evict the tenants. Is there anything we can do to speed up this process?
These folks have really made our lives hard. We have been nothing but honest landlord.
That's the system. On our street up there in Islip we have a house that went to foreclosure and then sold by bank and a family of slugs have been squatting for four months and last I heard still there. Moral of the Story- don't rent your house.
I am wondering how this worked out. Did they get the tenant out in 4 -6 weeks as they promised?
I am going through the same thing and hoping that the 4-6 week time frame is legitimate.
