A year ago a friend of mine asked me to share a rental apartment. Their name is on the 1 year lease.
Now the lease is up and my roommate and the landlord agreed on a month to month continuation of the rental.
My roommate told me I had to move out because he wanted another friend to move in.
What are my rights as a renter?
Can he kick me out like this?
I pay my rent and I am very clean.
What can I do?

Even if you could stay, why would you stay in a place where you're not wanted? It would just be asking for unnecessary drama. It would make your living situation very uncomfortable.

His name is on the lease, so, once it goes month-to-month, you don't really have much leverage legally.

Their name is on the lease, so the place is basically their responsibility. Your situation is very unfortunate, but there's nothing you can really do.

I'd sue for 'pain and suffering' or some other such thing.. might have a good shot at some big $$.

You can't sue and you have no standing. Be grateful for the year you had and freedom of not being locked into a lease and being able to have left whenever you wanted . Just look elsewhere and consider whether this friendship is less than you imagined it was. It may be time to move on in more ways than one.

My daughter is in the same position with a girl she's been rooming with for 2 years. She doesn't see a reason for the lease holder to ask her to leave but realizes that she could if she wanted to move her boyfriend in or something. They have talked about it and as year 3 begins Nov 1 the other girl asked if she was going to stay and my daughter said yes. Seems like it will work out for awhile longer anyway.

The OP pays rent which means they are a tenant. I think the tenant laws in California are pretty protective of renters. I don't think they can be thrown out of the apartment. You can't evict somebody unless you have cause to (like non-payment of rent.)

I remember an episode of Judge Judy where a single mom in CA rented a room out in her apartment to a woman who, it turned out, smoked medical marijuana in her bedroom. The mom moved out of the apartment to get her kids out of the situation. But the "tenant" didn't want to move and so the mom was still on the hook for her part of the rent. The roommate apparently had no intentions of moving either. Talk about a well intentioned law being abused. It takes a certain kind of individual to stick a single mom with that kind of expense...

your friend/roomate is a jerk. Let this be a life lesson. A lot of human beings are selfish pricks that have no empathy.

Which one were you referring to, rental law or medical mj law?

Looking at all the ridiculous lawsuits and their results, I'd say almost every part of the legal system is being abused on a daily basis.

I wonder what type of a relationship they had during the course of the year that he would want to let another friend* to move in instead? Does OP can not conjure up any reasons as to why he'd want to get rid of him/her?

Either way, regardless of having any legal leverage or not, I agree with Mike, why would you want to press on and continue staying some place where you are not wanted? I am guessing because either the rent is really cheap or there are some other conveniences.

Anyhow, if he gave you adequate notice (1 month), I'd say find another place and move on.

10 years from now, when you recall how stressed you were and realize how trivial it actually was, you will probably laugh at yourself.
