Very bad luck, we asked a small moving company to deliver a fridge, surprisingly, the mover just stole the fridge!!! Now the company tried to find the person but couldn't get him. They seemed kind of coorperated in locating him, but they refused to pay any penalty to us even if they couldn't find the thief in the future. I'm wondering what I should do in this case. Should I go to civil court and defend by my self? Usually how much this will cost?
I'm frustrated and shocked, appreciate any kind help!!!

I'm having a hard time understanding: so you hired a 3rd party company to pick a fridge up at a retail store (like Best Buy?) and deliver it to your house?

Who says they can't find the guy and won't pay: the 3rd party company that employed him, or the retail store you bought it from?

The retail store wouldn't have any responsibility if you hired a 3rd party company to pick something up and deliver it for you.

However if it's the 3rd party company who is telling you that they can't find their own employee and won't pay you, and now you're out $1000 or so for a fridge, then yes, that is completely their responsibility. How did you find this company? Is it a reputable place, or just a couple guys? Taking them to court yourself would be the way to go, however if it's just a couple guys, who knows - maybe they will disappear too. It might be helpful to hire a lawyer, or at least get some advice from one.

It's not the 3rd party, the mover was sent by the company. They work for the moving company.

I would threaten the hell out of them.

Then, I would

1) Call the police and report the theft.
2) Ask the company to tell you who bonds and insures its delivery people.
3) Sue them -- all of them -- the company, the driver, the bond agency, and the insurance company. Tennessee doesn't have small claims court per se. You will have to file a claim in General Sessions Court, which will cost you $200 - $300. However, WHEN you win your case, the defendant will most likely have to reimburse you for the court costs.

Best wishes.

Okay, so you didn't actual hire a moving company. The retailer just uses this company instead of having their own people on staff to do it.

Then yes, sue the retailer. How in God's name are they saying this isn't their responsibility? I'd go ahead and hire a lawyer immediately and let them deal with this. I can't imagine a well-known company would do this....but I guess I've heard of worse. *shaking head*

I do agree, tell the police, and also call a lawyer. The company will likely be more afraid of a laywer than you.
