Purchased a commercial building on land contract a couple years ago (5 year balloon with 3 years remaiining). Did many improvements on the property (all with approval of the contract holder). Got financing around with the bank to pay off the contract but the contract holder now wants to charge us for the remaining interest for the remainder of the contract term (which is NOT discussed in the contract). What are my options besides the following: 1. Pay the additional interest. 2. Pay a lawyer to fight it (could cost the same as the interest). 3. Not finance it and just pay the remainder of the contract.
Is there some type of governing board that could be a mediator? (BTW, the contract holder is an attorney)

How is the contract written? Does it allow for early payoff without penalty?

That would be my first question, too.

It's probably apparent by now, but you shouldn't buy property from a lawyer or real estate broker without getting your own legal representation. Lawyers, especially, can take advantage of lesser-informed purchasers if they have a mind to...and too many of them do.

The attorney may have written the contract to prevent early payoff...or he could be handing you a line of bull. In any case, you need to determine your legal rights under the contract. You'd be best off by consulting with an experienced real estate attorney. If that seems too daunting, expense wise, you should at least check to see if the Legal Aid Society could give you any advice. You should also check with them to see if they could help you file a complaint against the lawyer--once you determine whether you're in the right. Complaints against attorneys are filed with the Attorney Grievance Commission. http://www.agcmi.com/

By the way, what interest rate was charged in the land contract? Is the title clear? Did you get title insurance?
