Is it true that after being pulled over for (suspected) drunk driving, failing the breathalyzer test, that someone can drive until the court date, innocent until proven guilty? Weren't they proven guilty by blowing over the limit? Do the fines and penalties begin after having been tried?

Yes, you don't lose your license until you are convicted.

No, a breathalyzer is not a court, and you are innocent until proven guilty in a court of law in the US.

Was the breathalyzer machine working properly? Did the person operating the breathalyzer use it correctly?

A judge must be convinced that this is so.
