I would pay the two months and chalk it up to closing costs. You may jump through a lot of hoops to sublet, only to find out that if youre closing slips, you need to live out of a hotel for a few weeks, etc. and need to put your belongings in storage.

The banks are backed up with summer closings prior to school start times, and generally, ppl are diving into the market with interest rates rising. Delays happen more often then you would think.

We ended up re-renting our apartment with a friend that was flexible, and understanding that if our home closing slipped, she wouldnt be able to move in.

My in laws live within commuting distance to our jobs in NYC so worse comes to worse, we could live there.

Leaning towards option 1 at this moment.

Eating two months of rent for this fee would be pretty awful at this point financially for us.

I'm surprised you're surprised your landlord isn't budging in this

I would do option 3. Having an overlap between the closing and the rental ending relieves a lot of stress. But I can see why 1 could work for you too
