Hi, I received a lease renewal for Feb 2012- Jan 2013 but the funny thing is that I think they made a mistake because my lease isn't up til April 2012. Do you guys think I can tell the landlord to not raise my rent but to renew the lease for the new time period? The new lease they gave me has a $25 increase which I do not want to pay. Any advice?

The short answer is the landlord is required to give you AT LEAST a thirty day notice. You are required to do the same. The day your last month's rent is due (or before) you should advise them that you will not be renewing. If you have been a good tenant you are free to tell them in your notification why you choose not to renew your lease (remembering that moving is a big pain in the a$$ and may cost you more that the $300 a year you will be saving). Also, be prepared for new deposits, connection fees et cetera that you may have to pay for BEFORE you get your security deposit back. You never know, it might work!! Good luck.

PFR,

You are in a bit of an enviable situation. A landlord is NOT allowed to increase your rent more than ONCE in a 12 month period. Thus he is not allowed to move your renewal date up from Apr. 1 to Feb. 1.
As I vaguely recall you have 2 options and that one of them is you can sign the lease but not pay the increase because it is illegal. But remember I said VAGUELY recall.

What kind of apartment is it: rent controlled, rent stabilized, or market? (Sounds like you're stabilized and paying around $700?)

If your apt. is rent stabilized and your current lease needs to be renewed in April, it is perfectly legal for the landlord to send you the lease renewal notice in December or January with 60 days time to respond.

Again my statement was for a renewal of the lease after one year beginning in April. I have never heard of a landlord renewing a lease early. Also why would someone/a tenant want to pay extra rent for months covered by a lower rent in the current/old lease?
