Me and my spouse are trung to rent an apartment in NYC, she has good credit and enough income, I have bad credit and enough income also. Would saferent decline us even if there is one person on the ap who is strong enough to carry the lease despite the others bad credit?

Does she make enough money to rent the apartment without you? If so, you don't need to be on the application. Just add yourself as an occupant. This is not specific to Saferent, but most landlords do allow this as long as you don't have any evictions on your record.

NewYorker YEs she does make enough, BUT the building has to run the credit of every person over 18 on the lease. They dont have the occupant option.
But still, I would think that if one person is strong enough to carry the apartment solo then the application should receive a pass status from saferent, but who knows

They will run your credit but if you do not show up on the lease as a tenant (ie someone responsible for paying the rent) it's okay to have bad credit. The main thing they look for in occupant credit checks is evictions, and maybe bankruptcies. You will be named on the lease as an occupant but will not sign the lease, be responsible for the rent, etc. It's no different than a married couple renting an apartment with college-aged children living with them. The children show up as occupants and have a credit check but are not "tenants".

And to answer your question- the larger management companies will not allow you to move in if one of you has bad credit and both are named as tenants. I guess it also depends on what you mean by bad credit though. The way they see it if both of you are named as tenants you are each individually responsible for paying the rent so they need to trust both of you.

Then we have a problem because they will not allow allow an occupant unless the occupant is under 18. All people over 18 must be on the lease as a responsible tenant. But I listed my girlfriend as primary. I could pull me off alltogether and just have her apply but then I wont get a key card at all

It is illegal for landlord to restrict occupancy to the tenant named on the lease.
The New York rent law allows immediate family of the tenant and one additional occupant to live in the apartment, and they don't have to be on the lease.

This. I looked into it a few months ago and it's true. In fact, it was even in my lease.

Regardless of what the lease says, it is against NYS law to restrict the occupancy to only the Tenant and family.

Agreed.

Claim ONE tenant with good credit and enough income. Then move the second person in once the lease is signed.
However, if you need BOTH incomes to qualify, it's going to be dicey.
