I have a non-rent-paying family member living with me I would like to legally evict. They have been living here for over a year, but do not pay rent, and I have asked the person to leave, but they refuse. How do I legally go about getting rid of them? The apartment is rent stabilized, if that matters.

Are they living with you or are they renting an apt from you?

What part did you miss? LOL

OP, did you have a written agreement that indicates their share of the rent and are they on your lease?

just living with me and not paying rent; I am the renter paying rent to a land lord

I didn't ask them to pay part of the rent and still don't want them to; I just want them gone, rent or no rent. I'll check that link, thanks.

I see. Then you may need a court order and/or police to have them removed. If you've asked them to move out and they haven't, then it's considered trespassing.
