Hi,
anyone know how long we have to wait typically for nyc marshal to evict no paying tenant in 4 apartment building in Brooklyn.
Non payment court judgment was issued, tenant did answer notice, but didn't show up in court.
Is there any way to check status with NYC Marshal office?

If you are the landlord you have to call them and schedule the eviction. If you are the tenant you can call the Marshall and find out when you are scheduled to be evicted.

I don't think it's automatic. After a judgement is issued someone has to apply for a warrant of eviction and a judge has to order the eviction. Better keep on top of it unless you know for sure that an order for eviction was already issued.

Contact the NYC Marshalls and they will petition the judge for a "Warrant of Eviction." You must pay them their fees in advance before they will petition the judge to carry out the eviction. You must also decide if you want an eviction or a "legal possession." In an eviction, a moving company will come and take away the tenants possessions. You are also liable for locksmith fees if the marshall needs to break into the apartment and install a new lock and moving and storage fees if the evicted tenents don't pay to have their stuff returned to them (less money received from selling the possessions).

Sort of what I thought but wasn't sure of the exact steps.Sounds like the OP might have been assuming that it would all just happen automatically.

thank you for answers, but I'd like to know, how many weeks it takes typically in Brooklyn (after court ruled judgment on default) for Marshall to obtain warrant and schedule eviction.

How many free months have these freeloaders taken from you without paying rent? Has the apartment been damaged

Once you have been granted a warrant of eviction by a judge, around 4-6 weeks for the warrant to be issued. Once issued expect another 2 weeks to actually have the marshall knock on their door and remove them

Already 8 months, after sending rent demand letter, she started creating fake problems and submitting complaints with hpd and filed harassment with court.
Court now finally dismissed all complaints and harassment and granted eviction.
But she has started last week again calling 311 and loading them with fake complaints.(already 30 complaints).
Not sure about damages, access to inspect complaints or apartment was always denied.
Unbelievable, she doesn't pay and laughing, and only what you can do is just wait for months.
