So if I run out in the middle of FDR drive and get hit by a car, is that NYC DOT's fault? The MTA has a lot of issues but preventing actions that border mental retardation shouldn't be on them.

I got a better idea; how about Mrs. Nazario and rest of these parents teach their kids to stay the eff off top of trains.

Myself and hundreds of others who are bred, born and raised NY'ers have never felt need to ride on top of a train. Why? Because it was drummed into our heads that it was freaking dangerous thing to do.

As my mother often would say "it's all fun and games until somebody gets hurt".

Countdown begins to inevitable lawsuit filed against MTA, NYS, NYC and anyone else by this woman over "negligent" death of her kid . One or all of named defendants will pay something just go make lawsuit go away.

It's risky. Kids got to be smarter if they're going to take that risk. She needs to consider herself too. She probably didn't beat that kid enough when he was acting up and doing dumb stuff. If she did, he would know better.

Anyone with half a brain would not need to have it drummed into them that subway surfing was dangerous.
Darwinism at its finest. Zackery (really is that how it is spelled?) will not be contributing to the gene pool going forward.
