Hello-
My elderly mom opened her Binghamton home to a nice person who has been helping her with chores and errands. He has lived upstairs for several month. His adult daughter (chronic mental health issues) came to stay for a week which has turned into months. The daughter is very loud/abusive to her dad and does not contribute in any way. Mom called the police and they would not remove her and suggested calling the "city court" for an eviction.

My mom has a very limited income, is not well, suffers from confusion and memory loss. The daughter's behavior is affecting her health badly.

Can someone please provide guidance for:
1) What is the legal status of the daughter...squatter? Trespasser?
2) What would be the best way to get her out. Hoping to avoid undue expense and stress on mom.

Thank you!

Contact a lawyer. In NY the laws are stacked against your mom.
Once residency is established, it becomes extremely difficult to evict someone.

Thank you for the reply. I don't think she can afford a lawyer and her mental deterioration would make it extremely hard to work with a lawyer.

Find someone who does dirty deeds for reasonable rates.

Well, if that’s the case, y’all are screwed.
The only way to possibly end this in your favor is through the legal system.
In NY the laws heavily favor tenants, squatters and other degenerates.
