Hey Everyone, My car was recently towed from a private apartment complex and the tow truck complany held it hostage to the tune of two hundred dollars. When I got to the tow place I asked them for some proof the car was parked illegally which they refused to show me. I also asked to see their operator's license and their agreement with the apartment complex allowing them to tow away cars on their private property. They refused to show me any of that. My question is this; arent they supposed to be able to provide me those things on the spot as proof they had a legal right to tow the vehical? If not then it's technically considered stealing. Secondly, what government agency regulates tow trucks so I can file a complaint? Any help would be appreciated. -Daniel

Been there done that. The tow companies, and OPPD, steal regularly and with impunity. Just pay the fine and stock a few hundred dollars away for when you get taxed again.

I don't know off hand what the laws are in Nebraska to protect against predatory towing, but I know there will bills sponsored that would have granted authority to the Public Service Commission to handle these complaints. I don't know if they ever passed or not, but you might contact the PSC and ask them.

You might also consider contacting an attorney (maybe post this on Avvo.com) and see what protections the law provides. You could always consider filing a small claims suit to recover the costs you paid out as well.
