Hey,
so me and a few friends were staying in HB for the summer, we signed a 3 month lease agreement which expired at the end of aug. anyway last week we got a bill of $3500... we paid all our rent and fees during our lease term but they have threatened us with court if we don't pay all these fees for the time after our lease expired and during which time we weren't staying in the apartment... i'm not sure if we gave 30 days notice, but does that matter if the lease is for a fixed term? is what they're doing legal?? i'm not from the States so i'm not familiar with your laws.. i've attached a copy of the final bill... any insight would be really appreciated as i'm in a bit of a bind...

Are you sure the lease was for three months? You might want to double-check your written agreement.

well my friend has the lease and he says its dated from the 27th of May to the 27th of August....

It looks like they are saying you were given a notice to vacate on 09/15/10 and that the apartment was indeed vacated on that date. Then, they charged you rent for September ($1,765.00), used your security deposit to pay the rent, and also tacked on late fees and redundant charges.

It seems awfully fishy and I am not a lawyer, but if you did not agree to extend your lease beyond August 27 th and you did indeed move out before August 28 th, I don’t see how they can charge you.


If that is the case, I would send a certified letter to the landlord stating that I did move out by the end of the lease date, and did not sign a lease renewal. I would also demand that the landlord correct all errors on my record (You don’t want to get a bad reputation as a renter).

I know that every place I have ever signed a lease has required 30 days notice of vacating, otherwise they assume you're going to begin renting "month" to "month" once your lease term expires. You might want to read the fine print on the lease, that's usually where it states that 30 days notice is required. If that isn't on the lease, it doesn't seem like what they're doing is legal.
