I have nobody to blame but myself that I've waited till the last minute. In late Oct 2012, I received a Notice of Deficiency which stated that I owe $9,490 in taxes due. There are 90 days to respond (Oct 22). The problem is that the 1099 statements were not computed correctly. They have about $9,500 in additional reported income that does not jibe with the transcript that they gave me. I would send in the waiver with the taxes due, but I'm worried that I might give up my rights to contest the error that they have made in adding up my 1099 non-employment income. I understand that the Tax Court option requires filing fee and attorney. That seems prohibitively expensive. All that I want to do is send in the entire amount that they say that I owe, enclose the reasons why their computations are wrong. They can send me a refund for the difference once they see the error. I waited too long on this after requesting the initial extensions. The local guys at the IRS office are jokes. All they do is shove a bunch of publications in your face. The Phone people aren't helpful either and oftentimes seem kind of uneducated.
I'd like to avoid filing a 1040X if possible. I'm not sure if submitting the waiver disallows me from doing so.

Really? You think two days is going to matter at this point?

You need an attorney. Ideally an experienced tax attorney.
And you needed them last summer.

They won't cost you any less than the penalties you owe...
but they should settle it and far quicker.

What you do NOT need are pseudo legal opinions of strangers on the internet...
however good their agreeing with you about the IRS may feel.
