im a nonimmigrant working in the US (hoping to get greencard through employment eventually) and just got back from my home country after running out of my visa. since i was out of the US for 3 months, i decided to be terminated instead of being on leave (i didnt have enough leave credits anyway), so I took out whatever money i had in my 401k.

there's a possibility that i could return home again by the end of this year if DOL doesnt certify my application, so im asking. should i sign up for the 401k again and take it out again by the end of the year? or should i waive it and save the money? i could be out of US for at least 6 months, so i'm also worried about the impact all the 401k/withdrawal will have on my tax returns. do i still pay the US tax returns when im out of my job by end of december this year if the DOL denies my application?

if your employer matches...then YES enroll in the 401K. No sense to leave FREE money on the table.
