"Micaela Navarro, the Andalusia region's social affairs minister, says authorities are evaluating whether to let the mother and her family retain custody of the baby, born last week in the city of Jerez de la Frontera"
I'm glad the mother is all right but the article didn't mention the condition of the baby. How dare government officials decide whether the mother and her family can keep the baby or not. What right does the government have to take the child away from her family?

Perhaps they are concerned for the health welfare of the baby? What if this child was conceived as a result of incest? They should be considering removing the 10 yr. old from the home as well.
10 I don't believe that is common even in Romania. Maybe among gypsies
No idea of Spanish law, nor does it say whether or not that girl has parents willing to take care of the baby, either way I am pretty sure there is good reason why the authorities are looking into that case.

I checked out the news on elmundo.es. The child and the mother are both doing fine. Mother and child both remain with their family at this time.
The parties in question are gypsies from Romania (as opposed to Spanish gypsies who've been in Spain for 500 years). These folks are recent immigrants who for the most part are uneducated, unemployed, live off of begging and government assistance and live under precarious conditions.
The Spanish authorities in Andalucia are conducting an investigation to ensure the mother and child will be properly looked after in their current environment. They have to ensure there is no evidence of any kind of abuse. Please understand that in Spain, it is scandalous for a 10 year old to give birth. In Spain, a ten year old girl should not be having intercourse. The minimum age for consensual intercourse is 13 years of age.
The local Spaniards, who foot the healthcare and welfare costs of these Romanian (and other groups too) gypsies are a bit outraged. Unlike the Romanian gypsies, Spanish gypsies have a history of marrying at an early age. The newly weds go live with the groom's parents and there are strong family bonds in place that assist with young ones as well as the old ones. As always, exceptions do take place.
The government's response is pretty benign. Under Franco (and there are plenty of Spaniards who miss his regime), there would have been hell to pay and no such news would have been published.

10 year old child gives birth, could be some child abuse there from an adult pedophile male who impregnated her.

I think the government should look into the living situation that child is in and decide if they're FIT to raise ANOTHER BABY when the 10 year old girl wasn't apparently in the best of CARE TO BEGIN WITH BECAUSE SHE GOT KNOCKED UP BY A PEDOPHILE!
How the hell could anyone be against the government checking up on this situation?
At what age is someone no longer considered a minor in that area of Spain? If that was the US and the father/minor was 17, there would be HeII to pay.

Under Spanish law, having consensual sex with someone under age 13 is classified as child abuse, an official with the Spanish Justice Ministry in Madrid said. But this particular case is complicated by the fact that the father of the baby is also a minor and it is not clear if he could be charged, the official said.
Spanish newspapers said the mother is of Romanian origin.
The daily Diario de Jerez reported the girl was already pregnant when she arrived in Spain, but did not say when she came to this country. It is not clear if the father is in Spain.
