Free speech isn't crushed unless criminal charges are pressed. I don't think anyone endorses that action. Free speech does not absolve you from civil charges.
Hard to sue somebody for telling the truth, well you can bring suit, but win, probably not.
Saying the right wing pundits caused the tragedy and death threats resulting from that action will be difficult to defend unless you can prove it's actually true. Civil charges do not require beyond a reasonable doubt evidence.
