As for what is being asserted, the federal government has a right to decide how federal money is spent. It can therefore put rules in the bid documents that require the successful contractor to adhere to certain rules, like non-discrimination; equal pay; etc. Defense contracts are full of rules that contractors must comply or be deemed non-responsive.
I don't see anything wrong with the concept. I also see nothing wrong with requiring bidders to make available healthy food at beach snack stands or to be environmentally sensitive. The OP is trying to make something routine seem sinister.

So, placing requirements in a government contract for a government owned concession stand that requires foods should be less fattening for children is a bad thing and an abuse of power?
