I agree with DUI check points but I also don't see how someone can rationalize that they are within the constitution. How could searching someone's car for no valid reason be anything other than an illegal search.
The supreme court rulings have more to do with short comings in the constitution, I don't think they ever could have predicted the loss of lives from DWI's among other things, the world has changed quite a bit from 200 years ago.
Drunk driving is a bad idea, just as texting or applying makeup are, but in and of itself should not be a crime.
If you kill, injure or damage the property of another ( i.e. there is a victim),there should be a harsh penalty.
The courts ruled they are only a slight infringement on our rights so they stand. The courts basically said bend over and grab your ankles. Liberals of course are in that position from the time they are born so are used to it.
Again, look who voted for the checkpoints being legal, and who voted against. Hint: Justices Brennen and Marshall were considered 'liberal'.
Should similar fines and penalties be assessed to those who text or talk on the phone while driving? The risks rates are comparable.
Yep, I'd agree with that. I cannot stand people who talk or text while driving. They aren't paying attention, their reaction is for crap. Inevitably, if I see someone swerving or driving like an ass, 9 times out of 10, it's because they're on their damn phone. Same with drunk drivers. You can bet if I'm driving behind someone, usually at bar time or around that time, & they're swerving, it's because they're drunk.
It's like you people have no regard for your life or anyone else's, you're so against getting drunk drivers off of the streets. It's totally bizarre. Maybe you can set up your own community of drunk drivers that doesn't extend beyond the front gates?
It is illegal to text and talk on the phone while driving for that reason.
I don't think it's illegal to text & talk in my state. Maybe it is or maybe it's just for teen drivers? I don't know, but I don't think every state has that law.
Nope, and the reason is simple. Driving is not a constitutionally protected right.
Not saying I like it, but it is what it is.
