this myth is from the pupura/moran v obama case. obama's lawyer argued that the birth certificate was irrelevant to the case. plaintiff's argument was that both parents need to be US citizens to qualify as a "natural born citizen". since both the plaintiff and defense agreed that obama's father was not a US citizen the judge agreed that the birth certificate was irrelevant to the case.
