That said I have had a CWP since 87 and carry every day, and I would avoid such a confrontation that you described. Move away, and live for another day.

That's self defense without injuries.
But there would be proof that the other person was armed, the presence of the axe and their DNA on the handle. If the person was unarmed, you would have a harder time justifying self-defense.
You can't just shoot to death an unarmed stranger outside of your own home, unless you have some strong evidence that your life was in danger, or you were at risk of bodily harm. Just saying that you thought it was isn't sufficient.
TY for that info. I was figuring to go outside, shoot the 1st stranger I saw, and claim self defense.
If you accidentally bump into me, I come at you with a knife, you backbackback up, and finally shoot me. No injuries, still justifiable. Sure, it'd be better for you if there are witnesses, a video, but you've acted in legally justifiable self defense.
Morally no. But dead men don't talk. Use some common sense when discussing this subject. I'm very armed and would never consider the thought of just shooting someone who wandered onto my property. And I don't know of anyone who would.

In both states all that is required to take leathal action is to be fearful for your life. In Texas, you can even take leathal action to protect your property...
