Former NRA President: We Helped Draft Florida's "Stand Your Ground" Law

"There is no doubt about it. Marion Hammer, the NRA lobbyist here, former president of the NRA wrote the legislation and she would tell you so," Flemming told Media Matters.

Asked how he discovered that the NRA had co-written the legislation, Flemming stated: "She told me, I talked to her. I speak to Marion and certainly spoke to Sen. Peaden regularly. The observation is that they have their legislative priorities every year and that was one." He added, "All of the gun laws that come through the Florida legislature, she writes."


Hammer recalled that the law came about after an incident following Hurricane Ivan in 2004 in which 77-year-old James Workman shot an intruder who broke into his RV after the deadly storm. Months before the statute was passed, prosecutors declined to press charges against Workman, saying he had legally acted in self-defense.

"Yes, we helped," Hammer said. "Sen. Peaden and I had a conversation, he was outraged at what had happened and ... they had not decided whether to charge this man. He says, 'what are we going to do about it?' I said 'we can work on some legislation to deal with this issue.' It is not an uncommon problem."

She added, "he came to us, we helped draft it, he took it, he put it in the bill drafting, it came out of bill drafting, it came through the process, it passed."

The very fact that we need to enact legislation that legalizes self defense is a testament to just how far down the liberal crazy hole we've fallen.

In a more sane era, there was never a question or doubt that a person had the right to defend themselves from assailants and robbers, for the purpose of protecting one's person or property or family .. all three are just cause for action.

But today, to the liberal, we should all accept that criminals have a right to commit crimes against us without fear of life threatening response from the victim, and that we have no right to protect our persons and possessions unless the criminal announces ahead of time his intention to kill us while doing so .. then ... maybe ... it's OK ...but just to be safe, you might want to have the criminal put that in writing before you shoot him, otherwise it's just your word, and you cannot be trusted because you're a killer!

How the human mind can be twisted to think this way is one of the new mysteries of the ages.

Law says if you miss, it was a warning shot and that gets you an assault charge.

The law thereofre demands the potential perp be shot somewhere on the body or else the shooter gets charged.

She should have shot him in the leg but not kill him. The guy was harrassing her and then assaulted her but I probably would have left before it got that far.

greg has it right. a knife is just as deadly as a gun especially at short range. she is completely in the right and no charges should be filed against her.

Only going by what she said happened, yes. However, she should have stayed put and called the police.

I watched the video. Too bad it didn't have sound, because I would like to hear the argument that lead up to the shooting.

A warning shot? I don't know about TX, but in FL she would go to prison for a minimum of 20 years even if the bullet hit no one. Even if the bullet had only scrached his arm it's 25 years, and with taking a life, it's a life sentence.
