Two people involved in the planned home invasion in Niles that left one of the suspected burglars dead from the resident’s shotgun blast were indicted Thursday on murder charges.

Michael Burns, 33, and Mindy Sierra, 32, both of Mineral Ridge, were charged Thursday via a secret indictment with murder and a less serious option of involuntary manslaughter, and attempted aggravated burglary.

There is a longstanding legal concept that if you are involved in committing a felony, and someone gets killed - a fellow perp, an intended victim, anyone - you get charged with murder. Often called 'felony murder'. Great idea.

I could see charging them with involuntary manslaughter, but murder?? Seems like a stretch.

The law is designed as a disincentive to commit murder and to a lesser extent, felonies. It's harsh, but that is the intent.

Increase the penalty for felonies then, but to charge someone with murder when someone else killed their accomplish is a bit of a stretch.

The main goal is to prevent murder from occurring; the felony prevention is a secondary issue. Similarly, if you use a gun during a felony the crime/punishment is enhanced.

I don't how old the felony murder rule is or where it originated from, but it is far from new and every state has a version codified into their statutes.

It might be extreme or it might actually deter crime. I really couldn't say.

Please don't assume we know where Niles is located or that we know where WKBN is located. This is my gripe with many websites. They assume all of their visitors are local and that no one comes there via a link.

The way the law is written it looks like 4 people are going to be doing 7 to 10 years in prison, I think they will all be convicted.

If this had happened to me and I killed a home invader I'd be in jail right now basically presumed guilty until proven innocent. Our moonbat AG likes criminals having more rights than their victims and self defense is greatly frowned upon.
