Robert E Lee was not a traitor and neither was anyone that seceded. if anyone was a traitor, it was the traitor Lincoln as secession was a state right and the federal government should have never gotten involved.

If he was a traitor, then why was he never charged with treason?

Treason is defined in the United States Constitution..

Lee was not a traitor.

Secession was never a state right, it was never a right of any kind to begin with. So yes, Robert E Lee was a traitor to America as were anyone who fought for secession. It is no different than our founding fathers were traitors to England.

Lee was not a traitor.
Lee lost the right to vote and basically lost the right of citizenship in the US. He was later pardoned by President Johnson, but never regained citizenship until 1975 when President Ford reinstated his citizenship.

Robert E Lee was a traitor to the United States of America.
