I'm as pro-pot as they come. However; while his decision is asinine, it is his shop. If his business takes a hit from this policy, well.... then he may have to rethink his stance.
Valid, but as tamajane was saying there my be a possibility at coming at it from a medicinal perspective. If someone where to be able to prove that they had a severe disability that they had to have marijuana as part of their medical treatment for said disability, then there may be an angle you could go with to say that there would be Anti-Discrimination based on disability.
It's a decent sized if, and it would be a fairly weak argument because I'm fairly certain that they would have to prove that the smoker would HAVE to use pot as part of his treatment and not only that but he would have to smoke that pot and not use it in any other way (which is the more common form of severe treatment when it comes to marijuana), but the possibility could still exist.
For cryin' out loud, it's not like it's hard to mask the smell of cannabis on a person. For one, it doesn't linger very long, and for two that is what they make breath mints, mouth wash, and cologne for! Visine too... if need be.

All true, I hadn't thought of the medical angle. Seems that I've read somewhere though that a company can refuse to hire if a person is taking certain meds that might interfere with job performance. It's a reach for sure.
