Wonder how Justice Sotomayor would respond if Asian American brought up lawsuit against the Ivy League colleges for artificially keeping their enrollment at around 17%.

She probably would say "tough luck". "You Indians and East Asians don't need any minority help even those you are minorities and still get discriminated against in the real white collar executive world".

Yes or no? That's the way she would respond. See she can't play the race card by selectively giving some minorities an advantage when she would probably rule against affirmative action if an "over represented minority" brought up a lawsuit.

Yeah that's probably the case -- but she can be a hypocrite if she wants though and nothing's stopping her, she's a supreme court justice and pretty much gets to do whatever the heck she wants regardless of the law, politics, or anything really until she dies or retires. The only thing restraining her or any of the other justices are their respect for the rule of law and sense of decency, or lack thereof whichever the case may be.

You don't seem to have any sort of legal argument to make, unsurprisingly. And that "telling women to smile" thread was about dudes who make catcalls at women on city streets. If you think it's mostly "white men" who do that, well, I don't know what to tell you.

Thomas has been the recipient of some "affirmative action," I'm sure. But his look at his dissent in Grutter v. Bollinger, another affirmative action case. It's a masterpiece of legal argument compared to that illogical mess that Sotomayor embarrassed herself with the other day.

She's not an idiot. At least, not in some ways.

But she believes the purpose of government is to redress ancient wrongs, by favoring one group over another.

Which it clearly is not.

This clouds all her thinking, especially in cases like this one.

So, what kind of action was it that got Scalia and Thomas appointed? In my mind affirmative action is far better than the retarded action that got those two idiots on the court.

I don't think he should have been appointed at all. The controversy with Anita Hill should have disqualified him.
