Even before the lawsuit the plant owner said he wasn't leaving, but might expand elsewhere. As for the smell, at a guess theres going to be work to mitigate it.

That's what the Texans always ignored. The guy said he wasn't interested in moving out of state because all of his suppliers, locally owned farmers who he has been working with for decades, are here. He said he can only use a very particular type of pepper originating in SE Asia which isn't commonly grown in the US and when they're at the peak of ripeness he only has about one week to process and entire year's worth of peppers so his factory must be very close to the farms which grow the peppers.
