Birtherism was an idea, and its expression was protected by the First Amendment. It was a bad idea on the part of both Hillary and Trump, but it was neither treason nor even run of the mill illegal. Making an application to a judge is also a bad idea, but not illegal either.
Committing criminal acts to stop the Inauguration is on a whole different level.
