Are you sure? That's what happens in the UK, but in the USA, a judge can award costs to a plaintiff only if the lawsuit involves a contract or some other written agreement, which stipulates that a plaintiff is entitled to court costs and attorney's fees in any litigation arising from violations of the terms of the contract. The defendant is never awarded costs. Most residential leases have such a provision.
If the US courts could award costs to defendants, we would have a lot fewer lawsuits.
