If A and B have sex on 12/31/17 at 23:59 Person A is a felon. If they have sex on 1/1/18 at 00:00, they're not a felon...how exactly does that make any kind of sense? A little contrived? Sure, but that's exactly what the rest of you are saying you want. There MUST be some kind of age differential factor in determining things like this.
Are you saying that laws can never change? I thought that's kind of the whole point of this thread?

If you want to see the law changed in your state, then get busy. It's literally up to you.
But the new law will likely be as arbitrary as the old law, because enforcement people tend to like clear standards. As a matter of fact, so do a lot of other people. Imagine a prosecutor saying to a judge "well, your honor, the defendant is guilty because I think he is just too much older than the girl we caught him with."
It rarely works out well. The younger person needs more maturing time to make an informed decision, in most cases, and the power imbalance is really problematic too. I got married young to an older man and it was a great choice for us, but I was in college and a legal adult. Two or three years of time pursing adulthood makes a HUGE difference.
My mother started dating my father when she was 16 and he was 27. They married when she was 17 and he was 28. I was born when she was 18.
By all the discussion here of course he must have been a predator. But then again you do not know my mother.
She was extremely precocious. When they married she was 17 but she was also a junior in College. And my poor father was over matched from that day forward. She had 5 kids and a law degree by 32. And of course graduated from law school summa *** laude or such. Paid most of her way through law school by selling her notes to her classmates.
So be careful of those rules. In this case my father should have been protected from my mother...
Now this goes for both men and women. If, say, a 25 year old male or female is caught having had sex with a 16-17 year old, while they should be punished do you really think that should mean the offender deserves to spend decades in prison?
Of course not. It isn't against the law in most places for people that age to have sex, nor should it be. How would it benefit society to go to such extremes in controlling sexual behavior?

I do wonder for those that play hard and fast with the rule concerning those that are 16-17 do you feel it's somehow worse for a 25 year old to have sex with an 16-17 year old as opposed to say a 40 year old man having sex with an 18 year old?
Sure. Well I guess I should qualify that with if it is the standard for teachers who have sexual relationships with minors.
Thing is when it's a woman the media and courts like to portray the female offenders as "young pretty innocent little women that don't deserve a very harsh sentence".

I know of another couple that involved a 27 year old and a 13 year old. And 25 years later the lady who was 13 at marriage would tell you that it saved her life and was the best thing that ever happened to her...and this was after she had her first child at 15 in the back of a VW bug stuck in traffic on an LA freeway.
And that is of course the rub. My mother and this lady both profited greatly from very early marriage. But much of the laws would convert these males to predators.
Need a better way.
