Did I not read that article correctly?

Mama started the fight. The shooter shot her in self-defense.

Why shouldn't mama be charged?

Yeah, I don't get it either. The thread title is highly misleading.

Just so I understand, if I start an argument with my husband, he shoots me, and the bullet goes through me and kills our 16 year old, I should be charged in that murder? Something's not right here.

That's basically the title of the ABC news article.

Because only someone entirely unfamiliar with the English language would think that she intentionally caused the caused the death of the fetus.

Quote:
Jones "intentionally" caused the death of Unborn Baby Jones, the indictment states. She did so by "initiating a fight knowing she was five months pregnant," it states.
The indictment, therefore, is idiotic. Which is why it won't stand.

But, hey, it's Alabama...

If I understood correctly, the woman was in her car parked at a Dollar General. There likely was a verbal spat, but not physical force used. The shooting makes no sense and the indictment makes no sense. It was a Grand Jury run by a prosecuting Attorney. Hope we hear more about the particulars some day. It's just speculation for now.

This is confusing. Did the shooter have reasonable fear that her life was in danger? It's a little hard to tell from the articles released so far.

Yes, the shooter did have reason to fear for her life.

According to authorities, Jones was the aggressor in the dispute that day and continued to press the fight even after Jemison had gotten into her vehicle to try to get away. It was then that Jemison got hold of a gun and fired a shot at Jones to stop the attack.

I find it fascinating that major metropolitan news outlets are furiously scrambling to cast this case as a reproductive rights issue to "get back" at Alabama. They don't want you to know that Jemison, the shooter, was not the first person with whom Jones has initiated a physical altercation. The grand jury, however, heard that evidence.

“Unfortunately, some groups have attempted to tie this case to the anti-abortion law recent passed by the (state) legislature,’’ Chief Assistant District Attorney Powe said. “This case predates the passage of the legislation and we must point out the new law played no role in the consideration of the grand jury.”
