Seems the evidence was a bit sketchy for this to be a hate crime..... so they convict on a lesser charge but keep the hate crime thing to "send a message". Sounds good since they didn't go overboard and convict on the main charge as a hate crime. Prison time will probably be the same between the main charge without enhancement and the lesser charge with enhancement. Seems like a good balance between sending a message and being "fair" to the criminal....
